Attorney Barber secured a defendant’s verdict for the owner and operator of a family-run grocer who were sued by a plaintiff who had fallen inside their store.

On September 10, 2015, Attorney Barber secured a defendant’s verdict for the owner and operator of a family-run grocer who were sued by a plaintiff who had fallen inside their store.  The plaintiff had claimed that the business and its employees were negligent in creating a defect and failing to remedy it before the plaintiff’s fall.  The plaintiff claimed significant personal injuries including an arm injury that required surgery despite evidence uncovered by the defense that there was a prior injury that would have required the surgery she claimed.  Attorney Barber successfully argued that there was no defect and plaintiff simply fell because her flip-flops were wet from rainy conditions.  The jury deliberated for less than 30 minutes before returning a defendant’s verdict.
