Attorney Keith Rudzik Obtains Favorable Defense Result
On October 9, 2014, in the matter of Cabassa v. HartZito Properties-North, LLC, Attorney Keith Rudzik filed a motion for a directed verdict following two days of evidence arising out of a trip and fall accident that happened on raised flooring inside a condominium unit. The firm’s client was the condominium association who denied responsibility for the maintenance and repair inside the unit. The unit owner and plaintiff argued that the condominium association was responsible for the subflooring and that the subflooring was damaged. Attorney Rudzik successfully challenged that argument by showing that there was absolutely no evidence that there was anything wrong with the subflooring and getting the unit owner to admit that the unit owner was in exclusive control of any repairs or maintenance that needed to be made to the flooring inside the unit. Judge Sheila Huddleston agreed that the verdict should be directed in favor of the firm’s client and ordered the jury to find in favor of the association.
